BRIER CITY COUNCIL CHAMBERS
April 15, 2009
7:00 PM
Chairman Marley called the Brier Planning Commission meeting to
order at 7:01:27 PM.
ROLL CALL:
PRESENT: Commissioner Marley, Olson, Smith, Joplin
and Scott; Councilmember Kaemingk. Commissioner Magnuson arrived at 7:05:18 PM, Commissioner Thorpe arrived at 7:16:38 PM.
STAFF: City Planner Gaudette.
APPROVAL OF
MINUTES:
Chairman Marley opened for consideration approval of the November 19,
2008 Planning Commission minutes. Commissioner Smith
moved, seconded by Commissioner
Joplin, to approve the November 19, 2008 Planning Commission
minutes as written. Commissioner Olson abstained. Motion Carried.
Chairman Marley opened for consideration approval of the February 18,
2009 Planning Commission minutes. Commissioner Joplin
moved, seconded by Commissioner Smith,
to approve the February 18, 2009 Planning Commission minutes as written.
Motion Carried.
Chairman Marley opened for consideration approval of the March 18, 2009
Planning Commission minutes. Commissioner Olson
moved, seconded by Commissioner Smith,
to approve the March 18, 2009 Planning Commission minutes as corrected,
Commissioner Thorpe was absent. Motion Carried.
COMMITTEE REPORTS:
Councilmember
Kaemingk reported that Dave Gossett from the Snohomish County Council attended
a City Council meeting and spoke on Brier and Snohomish County being in sync regarding
development issues and regulations. Snohomish County is encouraging the City of
Brier to annex more areas.
The
Council has been having discussions regarding Paine Field opening up to private
corporations.
City Council
is working on the overlay project for 2009, deciding which roads need repair
and which need to have an overlay.
The City
Council has discussed the Murphy Detention Pond, the City is working with their
engineer to work out the problems that are happening.
The grand
opening of the Brier Skate Park is scheduled for April 18th.
The City
Council is working with home owner whose driveway runs thru the park access to
Locust Creek Park, to come to an agreement regarding the access to the park.
The City Council
approved on April 14th to move forward with the Balsam Park sewer
improvement LID, and run sewer along 38th Ave W for 13 residents.
The goal is to have this completed by the end of summer.
PUBLIC HEARINGS:
Chairman Marley
opened for consideration approval of the Conditional Use Permit #08-002 for use
of a septic system previously installed without obtaining a CUP from the City
of Brier. City Planner Gaudette gave an
overview regarding CUP #08-002 and the conditions for the CUP approval. The Public
hearing opened at 7:21:25 PM.
Robert Naff 22600 21st
PL W, Brier, has an objection to condition # 5, having to agree to an LID or
ULID in the future.
Mike Pellitteri 22818
Barker Rd, Bothell, questioned why the City would have any say in the
installation of a septic system. He
feels it is for the Health Department to determine.
Doug Fruhling 22806
Barker Rd, Bothell, commented on the process that Mr. McDonald had to go thru
to get his septic system approved.
Sean Doherty 1726
Larch Way, Lynnwood, he is in favor of approval for Tim McDonald’s CUP.
Vladan Milosavljevich
23423 Brier Rd, feels it is not necessary for Tim Mc Donald to go thru the CUP
process, supports approval of CUP #08-002.
Gary Morisett owns
vacant property on 227 PL SW and has recently applied for septic permit and was
denied.
Donna Reede 826 NE
123rd ST, Seattle, is Tim McDonald’s mother, expressed how she would
like to be able to build her house in the City of Brier.

Barker RD, not happy with how City of Brier has treated him. He has been trying to comply with all of City
of Brier requirements so he can move forward with his project.
The Public hearing
closed at 7:44:02 PM.
Commissioner Olson moved, seconded by Commissioner Scott, to
recommend to the Brier City Council approval of the Conditional Use Permit
#08-002 with the following conditions:
1. A City of Brier side
sewer connection permit shall be obtained prior to
connecting to a septic system.
2. All on-site utilities
shall be underground.
3. The septic tank must be
maintained in accordance with WAC 246- 272A-0270 and Snohomish County Health
Department regulations for optimal operation to prevent failure and public
health hazards.
4. Connection to the city
sewer system or public sewer shall be required if the Snohomish County Health
District determines that the septic system has failed and threatens public
health and a city or public sewer line is adjacent to the property or a public sewer line is within 200
feet of any part of the dwelling and the dwelling can be served by gravity flow
to the city or public sewer line or by a combination of grinder pump on the property
on which the dwelling is located and gravity flow to the city or
public sewer. Connection to
the system may include payment of any latecomer’s fees as may be appropriate.
5. Conditions 1 and 2 of
the Conditional Use Permit must be completed and receive final approval from
the City of Brier at the time the building permit is final and a Certificate of
Occupancy is issued.

NEW BUSINESS:
City
Planner Gaudette started discussion regarding the park mitigation plan. She
gave a brief overview as to what is required of the City of Brier and how many
acres for parks are required per number of residents. Gaudette went over what
type of park is required, per 1000 residents. Brier will need 7 acres of passive
parks & 5.5 acres of active parks. Gaudette recommended the Commissioners amend
the Comprehensive Plan to reduce the level of service and to change the ratio
to provide significantly more passive parks then active parks.
