BRIER PLANNING COMMISSION MINUTES

March 17, 2010
7:00 PM

Chairman Marley called the Brier Planning Commission meeting to order at 7:06:22 PM.

 

ROLL CALL:

PRESENT:                                  Commissioner Marley, Smith, Joplin and Scott. Commissioner Thorpe arrived at 7:24:30 PM. Councilmember Kaemingk.

ABSENT:                                    Commissioner Magnuson and Perry.

STAFF:                                       City Planner Gaudette.

 

APPROVAL OF MINUTES:

Chairman Marley opened for consideration approval of the February 17, 2010 Planning Commission minutes. The minutes were not approved due to lack of quorum of Commissioners who where present at the February 17, 2010 Planning Commission meeting.

 

COMMITTEE REPORTS:

Councilmember Kaemingk discussed recent City Council activity.

 

PUBLIC REQUESTS & ORAL COMMUNICATIONS:

Peggy Dare 22320 Hickory Way would like to see the Planning Commission get more involved with land use projects in the City.

 

PUBLIC HEARINGS:

Variance number V10-001

Chairman Marley opened discussion for Variance number V10-001. City Planner Gaudette gave an overview of the variance.

Courtney Kaylor with McCullough Hill 701 5 AVE Suite 7220, Seattle, representing PDI Properties, Inc, gave a detailed report of the Sunbrook Plat and the benefits of the variance. Chairman Marley opened the Public Hearing for variance number V10-001 regarding the reduction of front yard setbacks from 35 feet to 25 feet within the Sunbrook Plat at 7:36:11 PM. Chris Bowers representative of PERK, the appellant of the Sunbrook Preliminary Plat approval 19626 55 AVE NE, Kenmore asked the Commissioners to recommend approval for variance number V10-001. Clive Merriwether 16311 69 AVE NE, Kenmore is in support of the variance, but would like the city to consider Kenmore’s flooding situation. Keith Lindis 3266 224 PL SW is opposed to the variance and would have liked to have seen a site plan posted. He stated he is not happy that Sunbrook may get this variance approved but other residents who have asked for a variance have been denied. Dave Johnson 2711 234 ST SW is opposed to this variance. He feels not approving the variance could lead to smaller houses. Peggy Dare 22320 Hickory Way is opposed to this variance, she feels too many trees will be removed. She also thinks there needs to be a larger setback. Tim Dawson 5822 NE 204 PL, Kenmore is opposed to the variance. He would like to see smaller houses. The Commissioners addressed the applicant and City staff regarding comment from public testimony. There were no other comments. Chairman Marley closed the Public Hearing at 8:09:43 PM.

Commissioner Joplin made a MOTION to recommend to the City Council approval of variance V10-001, reduction of front yard setbacks from 35 feet to 25 feet within the Sunbrook Plat. Commissioner Scott SECONDED. Motion carried.

 

Updating Title 17 language

Chairman Marley opened discussion for updating the language in Title 17 regarding alcohol. City Planner Gaudette gave an overview of the language changes.  Chairman Marley opened the Public Hearing for updating the language in Title 17 regarding alcohol at 8:19:01 PM. Dave Johnson 2711 234 ST SW would like to see the code say beer and/or wine only sales, no spirit sales. Peggy Dare 22320 Hickory Way would like to hear more from the public on this topic. There were no other comments. Chairman Marley closed the Public Hearing at 8:26:34 PM.

Commissioner Smith made a MOTION to recommend the adoption of Ordinance No. 376 to the City Council updating alcohol licensing language. Commissioner Joplin SECONDED. Motion carried.

 

Updating portions of Title 16 and 18

Chairman Marley opened discussion for updating portions of Title 16 and Title 18 in regards to stormwater. City Planner Gaudette explained to the Commissioners the updates to be made. Chairman Marley opened the Public Hearing for updating portions of Title 16 and Title 18 in regards to stormwater management at 8:44:15 PM. Peggy Dare 22320 Hickory Way would like to see LID required in the city. She also made suggestions for language in Title 16 and 18. There were no other comments. Chairman Marley closed the Public Hearing at 8:54:02 PM.    

Commissioner Thorpe made a MOTION to recommend the adoption of Ordinance No. 377 to the City Council updating regulations that control run off from development, redevelopment and construction sites and updating wording where “superintendent of public works” has been replaced with “director or designee”. With recommended changes:

Title 16.16.150.1 to replace “2005” with “latest version”.

Title 16.16.150.a.vi add “as applicable” after “special reports and studies”.

Title 16.16.150.a.vii add “as applicable” after “other permits”.

Commissioner Smith SECONDED. Motion carried.

Commissioner Thorpe made a MOTION to adjourn. Commissioner Smith SECONDED. Meeting adjourned at 9:01:17 PM.
