Chairman Marley called the Brier Planning Commission meeting to order at 7:03:35 PM.

ROLL CALL:

PRESENT:                                  Commissioner Marley, Smith, Magnuson, Scott and Weston; Councilmember Kaemingk.

ABSENT:                                    Commissioner Myers and Carroll.

STAFF:                                       City Planner Gaudette.

APPROVAL OF MINUTES:

Chairman Marley opened for consideration approval of the December 21, 2011 Planning Commission minutes. Commissioner Smith made a MOTION to approve the December 21, 2011 Planning Commission minutes. Commissioner Scott SECONDED. Motion Carried. Commissioner Magnuson abstained.

COMMITTEE REPORTS:

Councilmember Kaemingk discussed recent City Council activity.

PUBLIC REQUESTS & ORAL COMMUNICATIONS: None.

PUBLIC HEARINGS:

Chairman Marley opened for consideration approval of Conditional Use Permit #11-003, Herzig Secondary Dwelling Unit. Commissioner Smith advised that he lives within 300 feet of the applicant, there were no objections to his participation to the public hearing. City Planner Gaudette gave an overview of the permit, City Staff recommends approval. Duane Herzig spoke on behalf of his project. Chairman Marley opened the Public Hearing at 7:11:49 PM.

Catie Corpron-Smith from Brier, supports approval of this CUP. She asked that the downspouts are connected directly to the storm system and that the applicant is not able to do construction work on Sunday’s. Chairman Marley closed the public hearing at 7:16:09 PM. Commissioner Magnuson made a MOTION to recommend approval of Condition Use Permit #11-003. Commissioner Scott SECONDED. There was Commissioner discussion. Commissioner Weston asked that the Pond near this property be considered when constructing this project. Commissioner Magnuson requested to add that the downspouts be tied into the storm system and that no construction work is done on Sunday’s. Commissioner Weston made a MOTION to amend the motion to add the following conditions:

1.     The downspouts will need to be tied into the storm system or are detained onsite.

2.     The applicant must follow BMC 8.08.030 section I.

 Commissioner Smith SECONDED. Motion Carried. 

Chairman Marley opened for consideration approval of Ordinance No. 390 for Chapter 17.12 Home Occupation Code amendments. City Planner Gaudette gave an overview of the proposed changes. Chairman Marley opened the Public Hearing at 7:36:20 PM. The public hearing was closed at 7:37:05 PM. Commissioner Scott made a MOTION to recommend approval of Ordinance No. 390. Commissioner Smith SECONDED. There was Commissioner discussion. Commissioner Magnuson would like the Exemption section removed. Commissioner Scott made a MOTION to amend the motion by removing 17.12.030 section B. Commissioner Smith SECONDED. Motion carried.

Chairman Marley opened for consideration approval of Ordinance No. 392 Chapter 17.40 Personal Wireless Communication Facilities new code chapter. City Planner Gaudette gave an overview of the new code. Chairman Marley opened the Public Hearing at 7:56:08 PM. The public hearing was closed at 7:56:48 PM. Commissioner Smith made a MOTION to recommend approval of Ordinance No. 392. Commissioner Scott SECONDED. Motion carried.

Chairman Marley opened for consideration approval of Ordinance No. 399 Chapter 8.32 Outdoor Lighting new code chapter. City Planner Gaudette gave an overview of the new code. Chairman Marley opened the Public Hearing at 8:04:33 PM.

Catie Corpron-Smith from Brier, would like to see some flexibility for being able to have lights at 45 degree angle. The public hearing was closed at 8:13:52 PM. Commissioner Smith made a MOTION to recommend approval to approve Ordinance No. 399. Commissioner Scott SECONDED. There was Commissioner discussion.

Commissioner Smith made a MOTION to amend the previous motion with the following changes:

1.     8.32.050 section B, strike out the last sentence and after the word ‘downward’ add, ‘or angle not to exceed 45 degrees’.

2.     Section E, change 150 watt to 75 watt and add per fixture.

3.     Change diagram in figure 4 to reflect the 45 degree angle.

Commissioner Marley SECONDED. Motion carried.

Chairman Marley opened for consideration approval of Ordinance No. 400 Chapter 17.48 Parking new code chapter. City Planner Gaudette gave an overview of the new code. Chairman Marley opened the Public Hearing at 8:36:58 PM. The public hearing was closed at 8:37:07 PM. Commissioner Smith made a MOTION to recommend approval of Ordinance No. 400. Commissioner Weston SECONDED. Motion carried.

MISCELLANEOUS BUSINESS:

Chairman Marley opened for discussion to nominate a new Chair and Chair Pro-Tem. Commissioner Smith made a MOTION to nominate Commissioner Marley for Chair. Commissioner Scott SECONDED. Motion carried. Commissioner Marley abstained.

Commissioner Magnuson made a MOTION to nominate Commissioner Weston to Chair Pro-Tem. Commissioner Smith SECONDED. Motion carried. Commissioner Weston abstained.
