BRIER PLANNING COMMISSION MINUTES
May 16, 2012

Chairman Marley called the
Brier Planning Commission meeting to order at 7:02:34 PM.
ROLL CALL:
PRESENT: Commissioner Marley,
Scott, Myers and Carroll; Councilmember Kaemingk. Commissioner Weston arrived
at 7:03:48 PM.
ABSENT: Commissioner Smith and Magnuson.
STAFF: City Planner Gaudette and
Building Official/Code Enforcement Eric Beverly.
APPROVAL OF MINUTES:
Chairman
Marley opened for consideration approval of the April 18, 2012 Planning
Commission minutes. Commissioner Carroll made a MOTION
to approve the April 18, 2012 Planning Commission minutes. Commissioner Scott SECONDED. Motion Carried.
Commissioner Myers abstained.
COMMITTEE REPORTS:
Councilmember Kaemingk discussed recent
City Council activity.
PUBLIC REQUESTS & ORAL COMMUNICATIONS: None.
PUBLIC HEARINGS:

Marley opened discussion for Conditional Use Permit
12-002 for Duane Herzig, Secondary Dwelling Unit. City Planner Gaudette
gave an overview of the permit, City Staff recommends approval. Chairman Marley
opened the Public Hearing at 7:12:04 PM. There was no public in attendance; the
Public Hearing was closed at 7:12:19 PM. Commissioner
Weston made a MOTION to recommend to the City Council approval of Conditional
Use Permit CU12-002, Herzig Secondary Dwelling Unit with staff recommended
conditions. Commissioner Myers SECONDED. There was Commissioner discussion. Motion carried.

Marley opened discussion for updating the Outdoor
Burning Ordinance. City Planner Gaudette introduced Fire Marshall Westfall who
gave an overview of the Ordinance. Chairman Marley opened the Public
Hearing at 7:21:09 PM. There was no public in attendance; the Public
Hearing was closed at 7:21:21 PM. Commissioner Scott
made a MOTION to recommend approval to the City Council of Chapter 8.04
Outdoor Burning. Commissioner Carroll SECONDED. There was Commissioner discussion. Motion carried.

Marley opened discussion for updating the Nuisance
Ordinance. City Planner Gaudette gave an overview of the Ordinance. Chairman
Marley opened the Public Hearing at 7:29:34 PM. There was no public in attendance; the
Public Hearing was closed at 7:30:00 PM. Commissioner Weston
made a MOTION to recommend approval to the City Council of Chapter 8.12
Nuisances. Commissioner Myers SECONDED. There was Commissioner discussion. Motion carried.

Marley opened discussion for updating the Parking
Ordinance. City Planner Gaudette gave an overview of the Ordinance. Chairman
Marley opened the Public Hearing at 7:42:06 PM. There was no public in attendance; the
Public Hearing was closed at 7:42:20 PM. Commissioner Scott
made a MOTION to recommend approval to the City Council of
Chapter 17.48 Parking and Storage of Vehicles. Commissioner Myers SECONDED. There was Commissioner discussion. Commissioner
Weston made a MOTION to amend the motion to change the first sentence
from ‘off site parking’ to ‘off street parking’ and ‘measured from the street’
to ‘measured at the street’. The second sentence should read, ‘Grades exceeding
6% shall be reviewed by the City Engineer’. Commissioner Myers SECONDED. Motion carried and main motion carried as
amended.

Marley opened discussion for updating the Junk and
Inoperative Vehicles on Private Property Ordinance. City Planner Gaudette gave
an overview of the Ordinance. Chairman Marley opened the Public Hearing
at 8:23:32 PM. There was no public in attendance; the
Public Hearing was closed at 8:23:41 PM. Commissioner
Weston made a MOTION to recommend approval to the City Council of
Chapter 8.36 Junk and Inoperative Vehicles on Private Property, with the change
where it says ‘Hearing Officer’ to ‘Hearing Examiner’. Commissioner Scott SECONDED. Motion carried.
MISCELLANEOUS
BUSINESS:
City Planner Gaudette gave an overview
of active projects throughout the City.
ADJOURNMENT:
Commissioner Myers made a MOTION to adjourn. Commissioner Scott SECONDED.
Motion carried. Meeting adjourned at 8:30:13 PM.
