BRIER PLANNING COMMISSION MINUTES

April 20, 2016
7:00 PM

Chairman Marley called the Brier Planning Commission meeting to order at 7:04:00 PM.

 

ROLL CALL:

PRESENT:                                  Commissioner DeMorett, Marley, Rosman, Scott and Weston; Councilmember Gallagher.

ABSENT:                                    Commissioner Thorpe and Jonart.

STAFF:                                       City Planner Gaudette.

 

APPROVAL OF MINUTES:

Chairman Marley opened for consideration approval of the March 16, 2016 Planning Commission minutes. Commissioner Rosman made a MOTION to approve the March 16, 2016 Planning Commission minutes.  Commissioner Scott SECONDED. Motion Carried.

 

Chairman Marley opened for consideration approval of the March 30, 2016 Planning Commission minutes. Commissioner DeMorett made a MOTION to approve the March 30, 2016 Planning Commission minutes.  Commissioner Rosman SECONDED. Motion Carried.

 

COMMITTEE REPORTS: None.

 

PUBLIC REQUESTS & ORAL COMMUNICATIONS: None.

 

PUBLIC HEARINGS:

Chairman Marley opened the Public Hearing to review the draft of the Animal regulations and its Ordinance at 7:06:27 PM. City Planner Gaudette presented a thorough review of the Ordinance updates.

Commissioner Rosman suggested to change section 6.12.020 limiting the number of cats & dogs as per premises rather then per person;

6.20.060.F change the wording to “Any person whose conditional use permit approval is revoked shall within ten days thereafter humanly dispose of all animals by removing from the property....”

Commissioner Marley 6.20.030.K, suggested to change the wording to “Overgrazed soil that results in muddy conditions, or that results in off-site run off from overgrazed soil is prohibited.”;

6.20.020 remove section J.

Commissioners recommended 6.12.020 be worded as “It is unlawful for any person to keep more than three cats or three dogs or a combination up to five…”

The Public Hearing was closed at 7:37:50 PM.

Commissioner Weston made a MOTION to recommend approval with the changes as discussed. Commissioner DeMorett SECONDED. Motion carried.

 

 

OLD BUSINESS:

Note: Let the record show that the applicant Vladan Milosavljevic left the meeting before his item opened for discussion. Chairman Marley opened for review the report summarizing the Planning Commissions’ recommendation to City Council regarding Variance 15-01, a variance to allow a building to be approximately 10 feet higher than the allowed height limit for Vladan Milosavljevic at 23005 27th Ave W. City Planner Gaudette gave a summary of the proposal and the process thus far. City Staff is taking another look at a couple of questions and would like some additional time to do so before the Planning Commission formalize any recommendation. Staff requested the Planning Commission to follow the three part procedure that was provided to them, which is the recommendation of the City Attorney.

 

Commissioner Scott made a MOTION to forward the report and recommendation to the City Council as written. Commissioner Rosman SECONDED. Motion postponed.

 

Commissioner DeMorett made a MOTION to postpone action on the report and recommendation to the date certain of May 18, 2016. Commissioner Scott SECONDED. Motion carried.

 

Commissioner Scott made a MOTION to authorize the Chair to re-open the hearing on the application if recommended by the City Attorney to the Chair on or before May 2, 2016, and give notice of the re-opened hearing in accordance with the requirements for notice of the original hearing. Commissioner DeMorett SECONDED. Motion carried.

 

ADJOURNMENT:

Commissioner Scott made a MOTION to adjourn. Commissioner Rosman SECONDED. Motion carried. Meeting adjourned at 7:43:59 PM.
