BRIER PLANNING COMMISSION MINUTES
November 16, 2016

Chairman Marley called the Brier Planning Commission meeting to
order at 7:00:37 PM.

Clerk-Treasurer Swisher, Building Official Beverly, City Engineer Robin Nelson.
APPROVAL
OF MINUTES:
Chairman
Marley opened for consideration approval of
the October 19, 2016 Planning Commission minutes. Commissioner
DeMorett made a MOTION to approve the October 19, 2016 Planning
Commission minutes. Commissioner Jonart SECONDED.
Motion Carried.
COMMITTEE REPORTS:
Councilmember
Gallagher discussed recent City Council activity.
PUBLIC REQUESTS &
ORAL COMMUNICATIONS: None.
PUBLIC HEARINGS:
A. Chairman Marley opened the Public Hearing for consideration
of #CA16-02 Stormwater Code Amendments at 7:02:24 PM. City Planner Balisky presented a review of
the amendments. There was Commission discussion.
Commissioner Rosman suggested adding to BMC 14.04.050 for
“Professional engineer” “in the State of Washington”. He also pointed out a
typographical error in BMC 14.04.180.D.4.
Commissioner Weston
suggested in BMC 14.04.130.H change to “Excavation less than four (4) feet in
vertical depth….”
Commissioner Thorpe
pointed out a typographical error in BMC 14.04.010.H.
The Public Hearing was
closed at 7:23:17 PM.
Commissioner Rosman made a MOTION to recommend approval to
City Council for adoption of the Stormwater Code BMC chapter 14, Code Amendment
No. CA16-02 with the following amendments:
Correction of the typographical errors,
Adding to BMC 14.04.050 for “Professional engineer” “in the State
of Washington”.
BMC 14.04.130.H change to “Excavation less than four (4) feet in
vertical depth….”
BMC 14.04.330.A change to “….misdemeanor and may be punished in
accordance with….”
Commissioner Weston SECONDED. Motion Carried.
B. Chairman Marley opened the Public Hearing for consideration
of #CA16-03 Parking Code Amendments at 7:25:20 PM. City Planner Balisky presented a review of
the amendments. There was Commission discussion.
Commissioner Scott pointed
out a typographical error in BMC 17.29.010.C.1.
The Public Hearing was
closed at 7:27:57 PM.
The Public hearing was
reopened at 7:28:40 PM.
Commissioner Rosman asked
a clarifying question regarding parking.
The Public Hearing was closed
at 7:31:49 PM.
Commissioner Weston made a MOTION to recommend approval to
City Council for adoption of the Parking Code BMC chapter 17, Code Amendment
No. CA16-03 with the correction of a typographical error. Commissioner Rosman SECONDED.
Motion Carried.
C. Chairman Marley opened the Public Hearing for consideration
of #CA16-04 Land Disturbing Activity Code Amendments at 7:32:46 PM. City Planner Balisky presented a review of
the amendments. There was Commission discussion.
Commissioner DeMorett suggested changing BMC 19.24.050.L
to “Routine landscape practices are not considered land disturbing activity.”
She would like to see a definition for “invasive species”. And change BMC 19.24.110.B
to say, “The land disturbance activities shall not result in off-site physical
damage,….”
Commissioner Rosman pointed out a typographical error in BMC 19.12.130.A.2
and suggested adding to BMC 14.24.250.P for “Professional engineer” “in the State
of Washington”.
The Public Hearing was
closed at 7:44:01 PM.
Commissioner DeMorett made a MOTION to recommend approval to
City Council for adoption of the Land Disturbing Activity BMC chapter 19, Code
Amendment No. CA16-04 with the following corrections:
Correct typographical errors.
Changing BMC 19.24.050.L
to “Routine landscape practices are not considered land disturbing activity.”
Adding a definition for
“invasive species”.
Change BMC 19.24.110.B to

Adding to BMC 14.24.250.P for “Professional engineer” “in the State

Remove from BMC 19.24.190.B “or gross misdemeanor”.

Commissioner Scott SECONDED. Motion Carried.
D. Chairman Marley opened the Public Hearing for consideration
of #CA16-05 Native Vegetation and Landscaping Code Amendments at 7:45:07 PM. City Planner Balisky presented a review of
the amendments.
Tony Corrado of Brier,
asked to have developers preserve more native trees rather then allowing them
to cut trees down.
Tom Hanson of Brier, asked
what the process is for determining what trees a developer has to preserve.
There was Commission
discussion.
Commissioner Rosman suggested
in BMC 17.50.250 to spell out in the table what “BN Zone” “PI Zone” and “UC
Zone” mean.
Commissioner Thorpe suggested
changing BMC 17.50.010.H to say, “….replace or enhance, to the maximum extent
practicable, the natural qualities….”, and add a definition of what is a
“required tree”. Also in BMC 17.50.290.B remove the word “appropriate”. He also pointed out a typographical error in BMC
17.50.300.D.4.a.
The Commission recommended
changing the table in BMC 17.50.250 to be maximum 40% turf and a minimum 15%
landscape area.
The Public Hearing was
closed at 8:59:42 PM.
Commissioner Weston made a MOTION to recommend approval to
City Council for adoption of the Native Vegetation and Landscaping Code BMC
chapter 17, Code Amendment No. CA16-05 with the following corrections:
Correct typographical
errors.
Define the table in BMC 17.50.250
what “BN Zone” “PI Zone” and “UC Zone” mean.
Changing BMC 17.50.010.H to say, “….replace or enhance, to the
maximum extent practicable, the natural qualities....”
Add a definition of what is a “required tree”.
