BRIER CIVIL SERVICE COMMISSION MINUTES

December 7, 2005
7:30 pm



Commission Chairman Szalda called the meeting to order at  7:30 PM.

 

ROLL CALL: Present: Commissioners Szalda, Nixdorf, and Zenk.

 

APPROVAL OF MINUTES: Commissioner Nixdorf moved and Commissioner Szalda seconded to approve the   Civil Service Commission Meeting Minutes of July 6, 2005, August 19, 2005, September 13, 2005 and November 2, 2005.  Motion carried.

 

NEW BUSINESS:

 

A.                  AMADOR APPEAL HEARING

 

Commissioner  Szalda opened for discussion the Amador Appeal Hearing. Commissioner Szalda stated a copy of a letter is in the Civil Service packets which indicates the issue has been completed to the satisfaction of everyone involved. Chief Lane affirmed. Based on the letter no further action is required by the Civil Service Commission. Appeal closed.

 

B.                  REMOVAL OF ENTRY LEVEL CANDIDATE STEVEN C. SMITH FROM THE ENTRY LEVEL ELIGIBILITY LIST.

 

Commissioner Szalda opened for discussion the removal of Entry Level Candidate Steven C. Smith from the Entry Level Eligibility List. Secretary Halverson reported Steven Smith has been hired by the City of Mill Creek Police Department and rejected the City of Brier’s offer of employment.  Commission agreed to remove Steven Smith from the Entry Level Eligibility List.

 

C.                  REMOVAL OF ENTRY LEVEL CANDIDATE MATTHEW H. PORTER FROM THE ENTRY LEVEL ELIGIBILITY LIST.

 

Commissioner Szalda opened for discussion the removal of Entry Level Candidate Matthew H. Porter from the Entry Level Eligibility List. Chief Lane reported Mr. Porter had failed the background. Discussion ensued. Commission agreed to remove Matthew H. Porter from the Entry Level Eligibility List.

 

     D.        DISCUSS REMOVAL OF ENTRY LEVEL CANDIDATE SHAUN D.        

                 GARDNER FROM THE ENTRY LEVEL ELIGIBILITY LIST.

 

Commissioner Szalda opened for discussion the removal of Entry Level Candidate Shaun D. Gardner from the Entry Level Eligibility List. Secretary Halverson reported Mr. Gardner has not responded to requests for background information sent to him by regular and certified mail. Secretary Halverson requested the Commission authorize the removal of Mr. Gardner from the Entry Level Eligibility List if he does not respond to the most recent notice sent to him within the10 days required. Commission authorized removal of Shaun D. Gardner if he fails to respond within the time frame given.

 

 

      E.       APPROVE LATERAL CANDIDATE KEVIN W. KILPATRICK FOR 

                APPOINTMENT.

 

Commissioner Szalda opened for discussion the approval of Lateral Candidate Kevin W. Kilpatrick for appointment. Chief Lane gave overview of Mr. Kilpatrick’s background investigation and qualifications. Discussion ensued.   

 

Commissioner Nixdorf moved and Commissioner Zenk seconded to appoint Lateral Candidate Kevin W. Kilpatrick. Motion carried.

 

  1.     DISCUSS PROCESS FOR REMOVAL OF CANDIDATES AND   

                RELEASE OF NAMES TO THE APPOINTING AUTHORITY.

 

Commissioner Szalda opened for discussion the process for removal of candidates and release of names to the appointing authority. Chief Lane requests verification regarding the process for removal of candidates from lists. Commissioner Nixdorf confirmed the Commission does have to approve the removal of names on the list. The Civil Service Secretary/Examiner can remove candidates if they have failed any portion of the background such as polygraph, psychological, etc… Commissioner Nixdorf stated if candidates need to be removed from the list prior to the next regular meeting a Special Meeting can be scheduled as long as there are two Commissioners present.

 

  1.     CHIEF - STATUS OF OFFICER JEFFERY DEKONING

 

Chief Lane informed the Commission Officer Dekoning has been terminated for a multitude of issues. Mr. Dekoning is appealing his termination to the Union, however, a resignation may be negotiated.

 

  1.    COMMISSIONER NIXDORF - WELCOMING OF MAYOR COLINAS

 

Commissioners welcomed Mayor Colinas. Discussion ensued regarding appointment or re-appointment of Commissioners. Secretary Halverson will check the City records for appointment termination dates of current Commissioners.

 

OLD BUSINESS

 

A.      DISCUSS STATUS OF NEW CIVIL SERVICE RULES

       

Commissioner Szalda opened for discussion the changes to the new Civil Service Rules.  Discussed recommendations from Mr. DiJulio. Discussion ensued and further changes requested. It was determined the procedures initially outlined in the Draft 4,   Section 4 – Hearings and Investigations, be re-instated in entirety with recommended language changes from Mr. DiJulio. Further discussion ensued. It was determined sections 14 – Amendments, and Section 11.1 – Suspensions, from Draft 4 be reinstated.

 

Secretary Halverson will prepare Draft 6 with the requested changes and present it at the next meeting. The Commission will then vote to adopt the rules at the next Regular Meeting. After adoption, a copy is to be submitted to the Police Association.

 

The Mayor will have to be notified of the changes made so amendments to affected ordinances can be made.

 

Commissioner Nixdorf informed the Commissioners of a separate set of Civil Service Rules for Non Uniformed Appointed Personnel. It was determined the Commissioners would review these rules and the issue would be on the next Civil Service Meeting agenda.

 

MISCELLANEOUS BUSINESS:

 

       A.        Next meeting scheduled for January 4, 2006 at 7:30 PM at City Hall.

 

ADJOURNMENT: Commissioner Nixdorf moved and Commissioner Zenk seconded to adjourn the meeting. Commissioner Szalda declared the meeting adjourned at 8:59  PM.
