BRIER CIVIL SERVICE COMMISSION MINUTES

February 1, 2006
7:30 pm



Commission Chairman Szalda called the meeting to order at 7:40 PM.

 

ROLL CALL: Present: Commissioners Szalda, Nixdorf, and Zenk.

 

APPROVAL OF MINUTES: Commissioner Nixdorf moved and Commissioner Zenk seconded to approve the   Civil Service Commission Meeting Minutes of January 4, 2006.  Motion carried.

 

OLD BUSINESS:

 

A.                  DISCUSS STATUS OF NEW CIVIL SERVICE RULES.

 

Commissioner Szalda opened for discussion the status of the New Civil  Service Rules. Chief Lane reports he wants to go over the proposed changes he had sent to the Commissioners to be sure the changes to the City Ordinances reflect the changes to the new Civil Service Rules. Chief Lane would like to have the Lieutenant’s position removed as he does not foresee this agency ever having both a Sergeant and Lieutenant position filled at the same time. Chief would like to add the position of Police Detective as it will also be a supervisory position to the Civil Service Rules. Discussion ensued regarding whether a Police Detective position should be a Civil Service issue.

Discussion ensued regarding changes to the Probationary Period language and qualifications. It was requested Secretary Halverson notify Public Safety Testing to add the applicant shall be a non-smoker to the list of qualifications for advertising purposes.

Further discussion ensued regarding the Detective position. Commissioner Nixdorf requested Secretary Halverson contact the Civil Service Attorney for clarification regarding this position. Further discussion ensued. It was determined the Chief would remove the supervisory section from the proposed  Detective classification.

 

                        Commissioner Nixdorf moved and Commissioner Zenk seconded to  

                        strike the Lieutenant’s position from the new updated Bylaws - Section  

                        8.7.3. Motion carried.

 

Further discussion ensued regarding corrections to grammar and spelling errors. 

Commissioner Szalda reiterated once the proposed changes are made the rules should be ready for adoption. Chief Lane reported the proposed changes to Ordinances will go to workshop on Tuesday the 7th and will be on the consent agenda for the Tuesday the 14th. The proposed new By Laws will also be made available to the City Council for review and comments. 

Chief Lane informed the Commission he believes the Rules will need to be adopted by the City Council by Resolution. Secretary Halverson will contact Civil Service Attorney, Mr. Dijulio, to clarify the process for adoption. Further discussion ensued.

 

 

NEW BUSINESS

 

A.                  DISCUSS HOW TO PROCEED WITH CIVIL SERVICE RULES FOR NON UNIFORMED APPOINTED PERSONNEL.

 

Commissioner Szalda opened for discussion how the Commission would like to proceed with the Civil Service Rules for Non Uniformed Appointed Personnel. Commissioner Nixdorf reviewed correspondence received from Attorney DiJulio which stated he would have to review all the City contracts, ordinance, etc… before he could make any determination or give any guidance. Mayor Colinas informed the Commission the City is currently in the negotiating process with the clerical and public works staff. Discussion ensued regarding the civilian staff’s grievance procedure to Civil Service per contract. It was determined it would be beneficial to have the negotiations completed prior to moving forward with this issue. The topic will be placed on the next agenda for further discussion.

 

B.                  ABOLISH CURRENT ENTRY LEVEL ELIGIBILITY LIST.

 

Commissioner Szalda opened for discussion abolishment of the current Entry Level Eligibility List. Chief Lane informed the Commission there are only two candidates left on the current list. One of the candidates responded with an incomplete background packet so he is no longer interested in him. The Chief requested the remaining candidate be placed in the new eligibility list. Secretary Halverson informed the Commission of the possibility of a challenge if they authorized integrating lists as the current rules do not allow for it. The Chief explained the remaining candidate will be processed but wants the new list certified so he can look at the new candidates when this list becomes exhausted. It was determined abolishment is not an issue as this list will exhaust itself.

 

C.                  CERTIFY NEW ENTRY LEVEL ELIGIBILITY LIST

 

Commissioner Szalda opened for discussion the Certification of the new Entry Level Eligibility List. Secretary Halverson reports testing was completed today, February 1, 2006, and candidates scored as submitted. No further discussion.

 

Commissioner Zenk moved and Commissioner Nixdorf seconded to certify the new Entry Level Eligibility List. Motion carried.

 

MISCELLANEOUS BUSINESS:

 

A.                  Mayor Colinas thanked the Commissioners for their time and participation 

            on the Civil Service Board.

 

ADJOURNMENT: Commissioner Nixdorf moved to adjourn the meeting. Commissioner Szalda declared the meeting adjourned at 8:20 PM.
