BRIER CIVIL SERVICE COMMISSION MINUTES

April 4, 2007
1:30 pm



Commission Chairman Szalda called the meeting to order at 1:33 PM.

ROLL CALL: Present: Commissioners Szalda, Nixdorf and Zenk.

APPROVAL OF MINUTES

Commissioner Nixdorf moved and Commissioner Zenk seconded to approve the minutes of February 26, 2007. Motion carried.

OLD BUSINESS:

  1. DISCUSS STATUS OF NEW CIVIL SERVICE RULES FOR NON-UNIFORMED EMPLOYEES.

    Commissioner Szalda opened for discussion the status of the new Non-Uniformed Civil Service Rules. Secretary Halverson reports these rules have not yet been adopted by the City Council. The rules have been forwarded to the new City Attorney, Rod Kaseguma, for review.

  2. VOTE TO ADOPT AMENDMENT TO SECTION 8.7.1 OF THE CITY OF BRIER CIVIL SERVICE COMMISSION BYLAWS FOR POLICE DEPARTMENT.
Commissioner Szalda opened for discussion the adoption of amendment to section 8.7.1. It was decided no further changes are required.

Commissioner Nixdorf moved and Commissioner Zenk seconded to approve the adoption of the amended changes to section 8.7.1. Motion carried.

NEW BUSINESS

  1. CERTIFY LATERAL POLICE OFFICER ELIGIBILITY LIST.

    Commissioner Szalda opened for discussion the certification of the Lateral Police Officer Eligibility List. Secretary Halverson reported Mr. Kinney has completed his background and is currently working as a Provisional Officer for the City. He will attend the Equivalency Academy in September 2007.

    Commissioner Zenk moved and Commissioner Szalda seconded to approve the Lateral Eligibility List. Motion carried.

  2. SET DATE FOR REVIEW OF APPEAL

    Commissioner Szalda opened for discussion the setting of dates for review of appeal regarding the petition of Mr. Evans.

    Commissioner Nixdorf moved to adopt the following pre-hearing schedule:

    April 20, 2007 By noon, the parties shall serve and file such motions(s), briefing and supporting declarations (if any) in support of or in opposition to Commission jurisdiction over the Petition of Tom Evans.

    April 30, 2007 By 5 p.m., the parties must serve and file responsive briefing and supporting declarations (if any).

    May 4, 2007 By noon, the parties must serve and file any reply materials.

    May 9, 2007 At 7 p.m., the Commission will hear oral argument (unless waived by the parties). The preliminary hearing will be heard on the submissions, only. There will not be live testimony. Each side will be allocated 30 minutes for argument. The Commission will then recess to deliberate and reach preliminary decision (not necessarily that evening). If it concurs with Mr. Evans, the Commission will schedule a cause hearing on the Petition.
The parties may serve each other and Mr. DiJulio by electronic mail, with hard copy to follow the next business day. Commission filings must be timely, to the attention of the Civil Service Commission, at Brier City Hall.

Mr. DiJulio is appointed as special counsel to the Commission and hearing officer to resolve any pre-hearing discovery disputes. Any party may appeal a decision of Mr. DiJulio to the Commission.

Commissioner Zenk seconded. Motion carried.

Discussion ensued regarding dates and times and document delivery methods.

MISCELLANEOUS BUSINESS:

  1. No miscellaneous business.
ADJOURNMENT: Commissioner Szalda moved and Commissioner Nixdorf seconded to adjourn the meeting. Commissioner Szalda declared the meeting adjourned at 1:40 PM.
